TERMS AND CONDITIONS CHRISTMAS DRAW
MAGIC ROBIN HOOD DRAW
1. Organizer
The company INDUSTRIAS HOTELERAS DEL MEDITERRÁNEO SL, from now on the organizer, with fiscal address:
Benidorm, Avda.L'Aiguera nº11 03500 Benidorm (Alicante), Telf. 96 585 11 21 and with CIF B-03058542 organizes a promotion in Facebook under the modality of SORTEO and in accordance with the bases detailed next.
2. Drawing period
The draw will be promoted from 14 December 2020 until 23 December 2020, at 23:59 (CET) on the official profile of the Magic Robin Hood accommodation on Facebook, with the winner being announced on 24 December 2020 in a publication on that facebook page.
Users can participate until 23/12 at 23:59 and as many times as they wish as long as they meet the conditions specified in the publication of the draw. Once the draw is closed, no more users can participate. Industrias Hoteleras del Mediterráneo is not responsible for late entries or fraudulent or incomplete participations.
3. Conditions of participation
Any natural person of legal age and with full capacity to exercise their rights may participate in the draw. Participation in the draw is free of charge.
No direct workers, family members or collaborators of the organiser may take part in this promotion. Minors are excluded from participating in the competition. To be able to take part in the draw, the participant must have a Facebook account and his/her profile must be public, so that the requirements of the draw can be checked.
4. Mechanics of participation
The draw will take place on Facebook, choosing a winner from among all those who participate and meet the established requirements. To participate in the draw, users must:
- Mention three or more people in the comments
- Sharing the publication (video) publicly
- Likes on the Magic Robin Hood Resort facebook page
The winner will be chosen by the organiser at random from all participants in the draw.
5. Prize and duration of the draw
The prize consists of 3 nights' accommodation in the Lion Heart 2 bedroom cabin for 2 adults and 2 children in an ultra all-inclusive regime at the Magic Robin Hood resort. It does not include travel for the winner or his/her companions, nor are any other expenses arising from the enjoyment of the prize included. The organizer reserves the right to modify the gifts for others of similar promotional cost, in case of force majeure.
The prize must be enjoyed during the opening periods of Christmas 2020 or during 2021, depending on the availability of the hotel, except for national holidays and the full months of July and August. Acceptance of the date of stay will also be conditional on the quota of free accommodation for that particular period. In the event that the prize is not enjoyed on the dates established in these rules, the winner will lose the prize and it may not be exchanged at a later or earlier date. In the event that the winner has reserved the prize stay, and subsequently needs to modify or cancel it, the corresponding cancellation fees will be applied. Likewise, the prize is personal and non-transferable and cannot be exchanged for another product, service or for its economic value.
To exchange the prize you must contact us by private message on the same page and communicate your chosen dates within a maximum of 10 days from the day of publication of the winner of the competition.
The winner of the prize will be subject to compliance with all the tax obligations established by the applicable legislation in force, where applicable, and will be exclusively responsible for paying these.
6. Other rules of use
Offensive, violent or pornographic comments; messages that invade or damage the privacy of others; insults, threats, foul language; degrading content or disqualification of any person, other members of the community or our products and service, brand or team are prohibited and will not be admitted. Such comments will be removed from the publication and the author will not be able to participate in the competition and will be automatically and immediately excluded from it. Similarly, any participant in the promotional draw who makes or is suspected of making use, handling and use of any means, systems or devices for automated and massive data entry or are carriers of viruses will be excluded from the competition. The organiser also reserves the right to take legal action against the author or person responsible.
7. Reservation and limitations
The organiser reserves the right to modify or cancel the draw during the course of the draw if just cause or reasons of force majeure prevent it from being carried out in the manner set out in these rules. In this case, he will communicate such modification. The organiser reserves the right to postpone or extend the period of the draw, as well as the right to interpret these legal conditions.
The organiser cannot be held responsible for computer failures and/or temporary service interruptions, the presence of viruses or other elements that could affect the internet service.
8. Acceptance of the rules
The mere fact of participating in the draw implies that the participant fully accepts the conditions of these legal bases, as well as the organizer's criteria regarding the choice of the winner and the resolution of any issues arising from it.
Likewise, the participation in a draw of this nature implies the acceptance of the rules of the social network where the draw takes place. This competition is in no way promoted, promoted or managed by or in collaboration with Facebook and/or Instagram.
9. Processing of personal data
In accordance with the provisions of current legislation on the protection of personal data, Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of individuals with regard to the processing of personal data and the free movement of such data and Organic Law (ES) 15/1999 of 13 December (LOPD) on the protection of personal data, participants in the promotion are informed that the data provided by all participants may be incorporated into the corresponding automated files of Industrias Hoteleras del Mediterráneo.

10.Applicable legislation
In any matter not covered by these rules, this draw will be subject to the provisions of the Spanish regulations applicable at the time it takes place. The competent courts to deal with any conflict or controversy arising from this draw are the Courts of Benidorm.
